Open Enrollment – Plan Year 2023:

The Family Glitch:
The “Family Glitch” was a hole in the Affordable Care Act (ACA) that caused low to moderate income families to not qualify for premium assistance on the health exchange. The “Family Glitch” based eligibility for a family’s premium subsidies on whether available employer-sponsored insurance is affordable for the employee only, even if it’s not actually affordable for the whole family.
IRS regulations fix the ACA’s ‘family glitch’ for Plan Year 2023. The rule change is fairly simple and straightforward: Instead of basing the affordability determination for a family’s employer-sponsored health insurance on just the cost to cover the employee, the determination will now be made based on the cost to cover the employee plus family members, if applicable.
The Public Health Emergency:
The U.S. Department of Health and Human Services renewed the national declaration of a COVID-19 Public Health Emergency (PHE). This renewed declaration was effective October 13, 2022. The Exchange continues to assume this declaration will last for a full 90 days. With this assumption in mind, key dates going forward are as follows:
- If this is the last renewal, then the PHE would end on January 11, 2023.
- If this is the last renewal, then the Medicaid continuous enrollment requirement would expire on January 31, 2023, and the first date on which a Medicaid coverage termination could be made effective is February 1, 2023.
